Essence of the Caribbean is the trading name of Zazoli Ltd. registered at Corrie Edge House, Corry Road, Hindhead, Surrey GU26 6PB, ENGLAND. Registration number: 6675564 / VAT Number: 936 9151 96. Its website – essenceofthecaribbean.com - has specific booking terms and conditions detailed below, together with the other information contained on its website, which form the basis of your agreement with the accommodation properties. Please read these terms and conditions carefully as they set out your respective rights and obligations.
The person who uses essenceofthecaribbean.com must be at least 18 years old, must accept these conditions on behalf of all members of the party and is responsible for all payment due from the party. By submitting an enquiry or booking request, you warrant and confirm to us that you have read these Terms & Conditions and agree to comply with them.
1. essenceofthecaribbean.com acts as agent only
All of Essence of the Caribbean accommodation is provided as an agent on behalf of third party suppliers ("Third Party"). Your contract for all arrangements, without exemption, will be with that Third Party. Essence of the Caribbean has a range of Third Party suppliers in the Caribbean and each Third Party has its own terms and conditions which will form the basis of your contract with them. When we acknowledge your booking request, you will be sent details of the Third Party’s terms and conditions. You must read these carefully. We act as agent only for that Third Party and we have no liability for any acts, omissions or promises made by the Third Party or their associated suppliers and agents.
2.Liability
In consideration of the fact that the Company acts only as a booking agent between you and the Third Party, the Company accepts no liability whatsoever for any aspect of the arrangements and in particular, accepts no liability for any loss, personal injury/illness or death however incurred. The Company uses all reasonable endeavours to ensure the accuracy of all information provided and the quality and facilities of the accommodation. We cannot accept any liability whatsoever for any problems that occur while guests occupy the accommodation of their choice. All information has been provided in good faith and no liability is accepted whatsoever by the Company for any misrepresentation of accommodation. Our liability to you if we are at fault in relation to any service we provide as an agent for the Third Party, is limited to the commission we earn or are due to earn in respect of the booking in question.
Essenceofthecaribbean.com contains links to third party sites where content is not controlled by essenceofthecaribbean.com. There the website cannot take responsibility for any content.
3. Making Your Booking
All enquiries and booking requests will be taken by telephone, email or via the website. To make a booking with an accommodation provider, your party leader must be over 18 years old and must be authorised to make the booking based on these Booking Terms and Conditions by all party members named in the booking. The party leader confirms that they are authorised to represent the party and that all party members agree to be bound by these Booking Terms and Conditions. Upon receipt of your booking request/deposit and other relevant information (if any), we will send you an acknowledgement by email. This acknowledgement is your confirmation that your booking request has been received by eesenceofthecaribbean.com and has been passed on to the relevant Third Party.
This confirmation receipt is not a confirmation of your booking. You should not enter into any other arrangements based on your booking (such as flight bookings) until you have received a written confirmation that the Third Party has confirmed that the property is reserved for you for the dates you require.
When your booking is confirmed by the Third Party, we will send this confirmation to your party leader. Please check this carefully. If any information is incorrect or incomplete you must contact us within 24 hours with the correct information. Change after this time may not be possible. We will have no responsibility for any errors in any documentation except where those errors were made by ourselves.
4. Your Contract
Your contract is with the Third Party and based solely on their terms and conditions. The contract commences at the time you receive confirmation that the property has been reserved for your dates requested and the deposit payment has been processed.
5. Payment
Deposit:
Each party has its own specific terms and conditions with govern all its bookings. A deposit payment is required for all accommodation and is payable on receipt of the booking confirmation indicating that the Third Party has availability for your requested dates. The exact amount of the deposit is outlined in detail in the booking confirmation along with the Third Party’s payment terms and conditions. A period of 5 working days is normally given for this payment to be received by essenceofthecaribbean.com. This period can be shorter for some Third Parties and in some seasons. All details will be given in the booking confirmation. Full payment is required as per third Party’s terms and conditions. If payment is not received by the due date, the offer may be deemed null and void and the booking cancelled. Under these circumstances, the deposit is non-refundable.
All payments are taken in GBP Sterling or US dollars. Payment can be made by cheque or by bank transfer to Essenceofthecaribbean.com or by Visa/Mastercard or Debit Card subject to a card processing fee of 3%. Essenceofthecaribbean.com will not accept responsibility for cash sent through the post. Booking confirmation together with contact details of the property and directions will be sent by email to you once the deposit payment has been processed.
If payment is made by credit or debit card to essenceofthecaribbean.com, your statement will show that you have been billed by ‘Zazoli Ltd'. All payments are taken in GBP Sterling.
6. Changes to booking
If you wish to amend your booking, you must contact essenceofthecaribbean.com in writing at the earliest opportunity at bookings@essenceofthecaribbean.com. All reasonable efforts will be taken to accommodate your requests but cannot guarantee until confirmed by the Third Party. An amendment fee will be payable in addition to any costs which may have been incurred by essenceofthecaribbean.com or any costs/charges incurred or imposed by the Third Party.
7. Cancellations and refunds
If you wish to cancel your booking, you must contact us in writing at the earliest opportunity at booking@essenceofthecaribbean.com. Deposits are passed on to the property owners/managers on receipt so this payment will be non-refundable. Essenceofthecaribbean.com adheres to the individual Terms and Conditions of all Third Parties and must therefore follow the specific cancellation and refunds policy of the relevant Third Party. These terms and conditions are clearly stated on each document you would have received relating to your booking.
It is highly advised that you take out adequate travel insurance to cover any potential loss in certain circumstances, medical cover and the cost of repatriation should it be required.
If you vacate the property prior to the end of the booking, this will be deemed as cancellation of the remaining time and no refund will be made.
If the Third Party changes or cancels your booking, you will be immediately informed along with any compensation that the Third Party may offer. As an agent for the Third Party, we cannot accept any liability whatsoever for any changes or cancellation made to these bookings.
8. Your responsibility
The accommodation that you have booked is contracted to you and your party by the relevant Third Party with the understanding and agreement that you will take full responsibility and care to ensure that you do not behave in a way which is offensive to others or which risks damage or harm to the property, others or their belongings. In the circumstances of any activity which breaches this agreement, the property owners and managers have the right to terminate all arrangements made on your behalf. Essenceofthecaribbean.com will bear no liability whatsoever and there will be no refunds, no payment of compensation and no reimbursement of any cost or expenses you may incur as a result. Further, you may be liable to essenceofthecaribbean.com for any expenses it incurs as a result of this situation.
9. Force Majeure, Events beyond our Control
Essenceofthecaribbean.com cannot accept liability or pay compensation as a result of force majeur. In these booking Terms and Conditions, ‘force majeur’ means any incident, event or situation which we could not foresee or avoid. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, Acts of God, natural or nuclear disaster, adverse weather conditions, and all similar events outside our control. The terms and conditions of each Third Party is applicable in this circumstance.
10. Complaints
It is of utmost importance to all property owners, managers and the Company that you enjoy the accommodation that you have booked. If there is any situation which you deem not satisfactory and requires a complaint, it is imperative that you contact the property owner/manager with whom your contract is, whilst on island at the earliest opportunity. All contact details are provided on confirmation of the booking. Essenceofthecaribbean.com cannot accept any liability whatsoever on behalf of the property owners/manager for any problems which arise with the property. In our capacity as agents and with your satisfaction as our priority, we will however attempt to address any complaint you cannot immediately rectify locally provided you supply us with written details within 7 days of your return.
11. Governing Law and Jurisdiction
These terms and conditions shall be governed in accordance with English Law.
